1. About these terms
These terms are an agreement between Motonology Ltd, trading as Track My Asset (a company registered in England and Wales, company number 12600399; business address Unit 11, Neath Vale Supplier Park, Resolven, Neath, SA11 4SR) (“we”, “us”), and the business that uses Fleet Tracker at https://app.trackmyasset.co.uk (“you”, the “customer”), including its authorised users. By using Fleet Tracker you accept these terms.
Fleet Tracker is a service for businesses, not for consumers. It is currently a restricted pilot: access is by invitation only, and no charges apply. If paid plans are introduced, the price and payment terms will be agreed with you before anything is charged.
2. The service
Fleet Tracker is a web application that shows you information about your own vehicles, received from the vehicle manufacturers’ built-in connected services through High Mobility (section 5). Depending on the vehicle, it shows:
- each vehicle’s last known location and status values such as mileage, ignition, fuel or battery level and warning lights, with the time each value was recorded;
- whether information is up to date, may be out of date, or is stale;
- up to 90 days of location history, which your administrators can export as a spreadsheet file (CSV);
- notices in the application, for example when a vehicle’s location becomes stale or its data access fails;
- user management for your business, an audit log of important actions, and a control to stop tracking a vehicle.
Fleet Tracker is not an emergency, safety or theft-response service, and it does not guarantee live tracking.
3. Accounts and security
- Accounts are created by invitation. Each person needs their own account; accounts must not be shared.
- Signing in requires a password and an authenticator app. Keep both secure and tell us at once at andy@motonology.co.uk if you suspect unauthorised use.
- Your administrators decide who in your business has access, and should remove access promptly when someone leaves.
- We may suspend an account or a session to protect Fleet Tracker, its users or their data.
4. Connecting vehicles: your authority and the authorisations needed
You may connect only vehicles that you own or are otherwise entitled to track. Before a vehicle is connected you must:
- have a lawful basis under data protection law for tracking it, and record that basis in Fleet Tracker;
- make sure everyone who drives it has been told about the tracking (a driver notice), and confirm this in Fleet Tracker;
- obtain any consent that the law or the vehicle’s manufacturer requires, including any consent the manufacturer asks for in its own app or portal.
Fleet Tracker asks High Mobility for access to a vehicle’s data only after these confirmations. Whether and when access is granted is decided by High Mobility and the manufacturer, not by us, and can take several days. You must stop tracking a vehicle when you are no longer entitled to track it, for example when it is sold.
5. Data sources and third parties
Vehicle data is provided by the vehicle manufacturers’ connected services through High Mobility (High-Mobility GmbH), an independent provider of connected-car data. Fleet Tracker is hosted by Amazon Web Services. Fleet Tracker is not affiliated with, endorsed by or a partner of High Mobility, Amazon Web Services or any vehicle manufacturer, and what they make available — which data, how often, and for which vehicles — can change or stop without notice to us.
6. Accuracy, delays and availability
- Vehicle data can be delayed, incomplete, approximate or unavailable. How often a vehicle reports, and which values it reports, differ between manufacturers and models; some vehicles report only after a journey or when a value changes.
- Fleet Tracker shows the time each value was recorded by the vehicle and marks older information as possibly out of date or stale. Do not treat information as current without checking its time.
- We aim to keep Fleet Tracker available but do not guarantee uninterrupted or error-free service. Maintenance, faults and third-party outages can make it unavailable.
- Do not rely on Fleet Tracker alone for safety-critical decisions, or as evidence, without checking the information independently.
7. Acceptable use
You must not, and must not allow anyone to:
- track a vehicle or a person without lawful authority, or use Fleet Tracker to stalk, harass or covertly monitor anyone;
- try to access another business’s data, or any part of Fleet Tracker you are not authorised to use;
- test, scan or bypass its security, or interfere with or overload the service;
- copy, resell, reverse-engineer or extract data from Fleet Tracker by automated means, except through features it provides;
- use data obtained from Fleet Tracker in breach of data protection law or these terms.
8. Your data and privacy
You remain responsible for the vehicle and driver data of your vehicles, and we process it on your behalf and on your instructions, under data processing terms that form part of our agreement with you. Our Privacy Policy explains how we handle personal data.
9. Intellectual property
We (or our licensors) own Fleet Tracker, its software and its content. While you are allowed to use Fleet Tracker, you may use it for your own business purposes under these terms. Your data remains yours. If you send us suggestions, we may use them without obligation to you.
10. Liability
- Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
- Subject to that, we are not liable for any loss of profits, revenue, business or goodwill, or for any indirect or consequential loss, and we are not liable for losses caused by the unavailability, delay or inaccuracy of data supplied by High Mobility or vehicle manufacturers.
11. Suspension and termination
- You may stop using Fleet Tracker at any time; stop tracking your vehicles first so that their data access is ended.
- We may suspend or end your access, or stop tracking particular vehicles, if you breach these terms, if required by law or by High Mobility or a manufacturer, or to protect the service or its users. Where reasonable we will tell you first.
- When your access ends, tracking of your vehicles stops and we ask High Mobility to end their data access. Your data is then handled as described in the Privacy Policy.
12. Changes to the service and these terms
We may change, add or remove features. We will give you reasonable notice of material changes to these terms by e-mail; if you continue to use Fleet Tracker after they take effect, the new terms apply.
13. Governing law
These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction.
14. Contact and complaints
Questions, concerns and complaints: e-mail andy@motonology.co.uk. We will acknowledge complaints and try to resolve them promptly. Privacy requests: see the Privacy Policy.
